The Parties have reached a proposed settlement for $7,000,000, consisting of $6.5 million in cash and $500,000 in Aqua Metals common stock or cash (the “Settlement”) for the benefit of the Settlement Class, which is subject to approval by the Court.
If you are a member of the Settlement Class, you are subject to the Settlement, and you may be eligible for a payment from the Settlement, unless you timely request to be excluded. The Settlement Class consists of the following:
All persons who purchased or otherwise acquired common stock or options to purchase common stock of Aqua Metals, Inc. during the Settlement Class Period, May 19, 2016 to November 9, 2017, inclusive.
Excluded from the Settlement Class are certain persons and entities (see question number 6 of the Notice) or those who request exclusion pursuant to the instructions set forth in the Notice (see question number 13 of the Notice).

Payments to eligible claimants will be made only if the Court approves the Settlement and a Plan of Allocation, only after any appeals are resolved, and after the completion of all claims processing. Please be patient, as this process will take some time to complete.
